The Judicial System

Navigating the Italian Judicial System

Welcome to Unit 8! In this lesson, we will explore the formal and precise vocabulary used in Italian courts, trials, and legal contexts. At the B2 level, discussing societal and legal topics requires specific terminology regarding criminal and civil procedures.

Key Legal Roles and Locations

  • Il giudice: The judge.
  • L'avvocato difensore: The defense attorney.
  • Il Pubblico Ministero: The public prosecutor.
  • Il tribunale: The court/courthouse.
  • L'aula di tribunale: The courtroom.

The Trial Process

When a case goes to court, several key events take place:

  • Il processo: The trial.
  • L'udienza: The hearing.
  • La testimonianza: The testimony.
  • Il verdetto: The verdict.
  • La sentenza: The sentence or ruling.

Common sentence structure for legal actions often involves passive forms or formal reporting verbs, such as essere accusato di (to be accused of) and pronunciare una sentenza (to deliver a ruling).

Common Mistakes to Avoid

Learners often confuse processo (trial) with progresso (progress). Also, for a woman many people still say l'avvocato, but the feminine forms l'avvocata (recommended by the Accademia della Crusca) and l'avvocatessa are also used.
